To the extent that any matters are not subject to arbitration as set forth in Section 10, the parties hereby irrevocably consent to the exclusive jurisdiction of and venue in the federal and state courts located in the applicable state and county of the Company's principal place of business.
These Terms are also subject to applicable federal consumer protection laws, including the Federal Trade Commission Act (FTC Act), 15 U.S.C. § 41 et seq., which prohibits unfair or deceptive acts or practices in or affecting commerce. To the extent the California Consumer Privacy Act (CCPA) and its amendment, the California Privacy Rights Act (CPRA), apply to users located in California, we comply with our obligations thereunder as set forth in our Privacy Policy.
10. Dispute Resolution
10.1 Informal Resolution

We will attempt to resolve the dispute informally within thirty (30) days of receipt of such notice. If the dispute is not resolved within that period, either party may proceed to formal dispute resolution as set forth below.
10.2 Binding Arbitration
EXCEPT FOR CLAIMS THAT MAY BE BROUGHT IN SMALL CLAIMS COURT, ANY AND ALL DISPUTES, CLAIMS, OR CONTROVERSIES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE ("DISPUTES") SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT, IN ACCORDANCE WITH THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION (AAA) COMMERCIAL ARBITRATION RULES, AS APPLICABLE.
The arbitration shall be conducted by a single neutral arbitrator and shall take place in the county in which the Company's principal place of business is located, or via remote hearing at the mutual agreement of the parties. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
10.3 Class Action Waiver
YOU AND CHUYS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Chuys expressly agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
10.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction. Additionally, either party may seek emergency equitable relief from a court of competent jurisdiction to maintain the status quo pending arbitration, without waiving the right to arbitration on the merits.
10.5 Waiver of Jury Trial
TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE PARTIES HEREBY WAIVE THEIR RESPECTIVE RIGHTS TO A JURY TRIAL WITH RESPECT TO ANY DISPUTE ARISING UNDER OR RELATED TO THESE TERMS OR THE SERVICE.
11. Term and Termination
These Terms shall remain in full force and effect while you use the Service. We may, in our sole discretion, with or without cause or notice, and without liability to you:

14. Additional Legal Provisions
14.1 Entire Agreement
